Workers who were exposed to asbestos through their work in the NWT have no right of action and must apply to the WCB. Only the Board may commence an action. Applicable legislation follows:
Workers' Compensation Act, SNWT 2007, c 2164. (1) Any cause of action that an eligible claimant may have against any other person in respect of a personal injury, disease or death suffered by a worker, arising out of and during the course of his or her employment, vests in the Commission.
