How Do I sue Someone?

When can you start a lawsuit?

To begin a lawsuit a statement of claim must be filed against the person who you feel has wronged you and caused physical or economic loss. This starts the litigation process. Unlike many criminal proceedings, intent does not have be proven in a civil context. Where individuals have acted deliberately, in addition to that actual amount you have lost, the court may also award punitive damages (damages awarded to punish the plaintiff or defendant and to deter them from engaging in future wrong doings).

Lawsuits brought or defended in Ontario require serious consideration. The person who loses of a lawsuit is generally required to pay the cost of the successful party, in addition to their own lawyer’s fees. Taking an action to trial is very expensive for both parties but particularly for the party losing and required to pay costs. This is why the decision to sue or defend should be taken after careful consideration with a lawyer. A qualified lawyer will discuss the pros and cons and whether settlement should be attempted and resolve the action without the need of trial. Options available may involve mediation or arbitration.

Individuals can commence a civil litigation actions by themselves, but this is not recommended as the process is quite complicated and rule intensive. The Court or the court staff will not assist with any legal issues that might arise.
